“Meet 50 Cent” Sweepstakes

OFFICIAL RULES

NO PURCHASE NECESSARY TO ENTER OR WIN. 

SPONSOR:  The Sweepstakes is sponsored by Street King LLC, 208 E. 51st Street, #181, New York, NY 10022 (“Sponsor”).

SWEEPSTAKES PERIOD:  The “Meet 50 Cent” Sweepstakes (the “Sweepstakes”) begins at 10:00 P.M. Eastern Time (“ET”) on Friday, April 27, 2012 and ends at 11:59 P.M. ET on Friday, June 29, 2012 (the “Sweepstakes Period”).  50 Cent is hereafter referred to as the “Artist”.

ELIGIBILITY: The Sweepstakes is open to legal residents of the 50 States of the United States, excluding Rhode Island and the District of Columbia (“Sweepstakes Territory”), who are age 18 or older at the time of entry.  The Sweepstakes is void outside the Sweepstakes Territory and wherever else prohibited by law.  Employees of Sponsor, Artist, their respective affiliated companies, management companies, subsidiaries, affiliates, advertising and promotion agencies and any company in which the Artist or any Artist affiliated company owns a controlling share, and the immediate family members of, and/or those living in the same household of each (whether or not related), are not eligible to enter the Sweepstakes.  The Sweepstakes is subject to all applicable federal, state and local laws and regulations.

HOW TO ENTER:  A potential participant (an “Entrant”) in the Sweepstakes may enter in one of two ways by meeting the following requirements to create an eligible entry (an “Entry”, term may be used in singular or plural form):

I. Coupon Redemption.

  1. First print a coupon for $1.50 off a bottle of SK Energy.  Coupons for SK Energy are accessible at:
    i.     www.facebook.com/streetking
    ii.    http://twitter.com/#!/streetking, or
    iii.   www.coupon.streetking.com.
  1. After printing a coupon for $1.50 off a bottle of SK Energy, a potential Entrant must provide his/her full name, gender, email address and zip code when prompted.
  2. Next, a potential Entrant must redeem the coupon when purchasing a bottle of SK Energy at any participating retail location within the Sweepstakes Territory.
  3. A potential entrant who correctly supplies all necessary identification information when printing his/her coupon and then redeem the coupon for the purchase of a bottle of SK Energy during the Sweepstakes Period will be automatically entered into the Sweepstakes.

This Sweepstakes is in no way sponsored, endorsed, administered by or associated with Twitter or Facebook.  You understand that you are providing your information to Sponsor and not to Facebook or Twitter.

II. Mail-in Entry.

  1. A potential Entrant must print his/her name, mailing address (no P.O. Boxes), email address and phone number on a 3×5 postcard and mail to: Meet 50 Cent Sweepstakes Entry, 208 E. 51st Street, #181, New York, NY 10022.
  2. Upon receipt, and a potential Entrant’s successful supply of the information requested above, mail-in entries will be treated in the same manner as coupon redemption entries.

All Entries become Sponsor’s property and will not be returned or acknowledged.  Illegible Entries and Entries with P.O. boxes are void.  Sponsor is not responsible for lost, late, damaged, incomplete, misdirected, mutilated, postage due, or Entries not received in time for drawing.  All mail-in Entries must be post marked no later than June 29, 2012 and received no later than July 13, 2012.

Sponsor will only accept Entries during the Sweepstakes Period.  Limit one (1) Entry per person/address/email address no matter what method of entry is used.  Entrants are subject to all notices posted online including, but not limited to, Sponsor’s Privacy Policy.  Participation in the Sweepstakes constitutes Entrant’s full and unconditional agreement to and acceptance of the Rules and any rules, policies and procedures of twitter and Facebook.

Submission of an Entry to the Sweepstakes does not indicate that the Entrant has complied with the Rules and the rules, polices and procedures of twitter and Facebook.  Sponsor reserves the right, in its sole and absolute discretion, to reject, disqualify and/or remove any Entry that is incomplete or in violation of these Rules and/or any rules, policies and procedures of twitter and Facebook without any notification or warning.

Winner Selection:  Two (2) potential winners will be selected in a random drawing from among all eligible Entries received during the Sweepstakes Period on or about July 16, 2012.  An independent sweepstakes administrator, who will be selected at Sponsor’s sole discretion, will conduct the drawing.  Potential winners will be contacted by e-mail at the e-mail address provided upon downloading a coupon or the mail-in Entry and be requested to confirm their shipping address via email within seven (7) calendar days of notification. Return of any prize or prize notification as undeliverable, or if a winner is found to be ineligible or otherwise not in compliance with these Rules will result in the prize being forfeited and an alternate winner may be selected in a random drawing from among all remaining eligible Entries.  Three (3) alternate drawings will be conducted after which the prize will remain unawarded.  Prizes will be fulfilled one (1) year from the date of the drawing.  All decisions of Sponsor are final.  Odds of winning a prize are dependent upon the number of eligible Entries received.

Upon notification as potential winner, such potential winners must prove eligibility, including, without limitation, proof of age and residence.  Each winner must sign, upon notification and acceptance of the prize, an affidavit of eligibility and release of Sponsor, the Artist and their respective officers, directors, employees, agents, members, affiliated companies and subsidiaries, from any and all liability, loss, claims, demands, and causes of action for personal injury and/or damage, theft, loss, or any other harm suffered in connection with this Sweepstakes directly or indirectly from acceptance, possession, or misuse of any prize or participation in this Sweepstakes to be eligible for the prize.  Entry into this Sweepstakes constitutes agreement to sign such affidavit.  Each winner must acknowledge that Sponsor has not and will not obtain or provide insurance of any kind relating to the prize and that each winner will be responsible for obtaining and paying for any form of insurance relating to the prize.  Each winner must also complete any additional legal documents provided by Sponsor with respect to the prize and return them as instructed within the time frame specified by Sponsor or forfeit the prize at Sponsor’s sole discretion.  Where permitted by law, in consideration for being awarded a prize, each winner hereby agrees and consents, without further authorization, compensation or remuneration of any kind, to the use of his or her name and/or likeness, as submitted in connection with the Entry or in connection with the prize in any and all advertising, promotions and other publicity conducted by Sponsor in connection with the Artist and the Sweepstakes.

Prizes: Sponsor will award two (2) winners a trip to New York, New York for a chance to meet the Artist (the “Prize Trip”).  Each winner may bring one (1) guest that is 17 years of age or older.  Each winner’s Prize Trip includes hotel accommodations for up to three (3) days and two (2) nights in a double-occupancy hotel room including any applicable room charges and taxes, round-trip coach airfare for two (2) from a major airport closest to a winner’s residence and an allowance of $100 USD total for the entire trip for transfers between the airport/hotel.  (All hotel accommodations and travel arrangements will be determined by Sponsor.)  Total ARV of prizes $5,000.00.  No more than the stated number of prizes will be awarded.

Prize Restrictions: Limit one (1) prize per individual/household. Prizes are non-transferable, and no substitutions are allowed except by Sponsor, who reserves the right to award a prize of equal or greater value, should the prize become unavailable for any reason.  Any and all taxes and costs associated with the receipt and use of the prize are the responsibility of the winner.  Each winner is responsible for the reporting and payment of all applicable federal, state and local taxes (including income taxes) of the Prize and will hold Sponsor harmless from liability for failure to timely report and/or pay such taxes.  By accepting any prize, each winner consents to use of his/her name or likeness for advertising/publicity purposes without further consideration, except where prohibited by law.  Each winner and his/her guest must travel together on the same itinerary.  Each Winner and guest are responsible for obtaining all travel documents at their own expense.  Sponsor is not responsible for any expenses incurred as a result of flight cancellation or delay.

If a guest cannot attend, a winner is not entitled to the difference between the value of the prize and the actual cost of the trip.  There is no refund value for unused amenities on a trip and no cash value is due if the trip is cancelled or a winner or his/her guest is a no show.  All hotels have their own cancellation policy which may result in additional fees to winner and his/her guest.  The dates of the Prize Trip are subject to availability, and blackout dates apply.  The Prize Trip assumes a mid-week departure.  Additional taxes and fees may apply if travel is booked on different days of the week than mid-week.  All airline tickets are non-refundable and the names of the winners and each guest printed on the tickets need to exactly match proof of citizenship.  Many airlines charge an additional fee for luggage.  Failure to check in for your flight in an appropriate amount of time may result in denied boarding.  Each guest will be required to sign a release and waiver.

Prize Conditions and Limitations:  All travel related expenses for gratuities, incidentals, upgrades, insurance, service charges, hotel, resort or property fees, food & beverage and personal expenses such as but not limited to telephone/Internet charges, room service or mini bar charges, souvenirs, sightseeing and gift shop purchases are the sole responsibility of each prize winner and his/her guest.  Each prize winner and guest must travel on same itinerary.  Each prize winner and guest must have valid identification and/or a passport prior to departure.  Airline regulations apply.  Travel is subject to availability.

All travel arrangements must be made through Sponsor’s agent, on a carrier of Sponsor’s choice and all prize trips must be booked a minimum of forty-five (45) days in advance. Travel dates are subject to availability and certain black-out dates and other travel restrictions may apply.  Sponsor reserves the right to approve any travel dates.

All hotel reservations are based on availability and certain holidays may be excluded.  Availability is subject to factors such as weather, seasonality and space availability.

If weather affects the ability for a prize winner and his/her guest to redeem any portion of prize during the scheduled date and time, Sponsor shall have no further obligation to the winner and/or guest other than to supply the remaining elements of the prize package minus the unused portion of prize.
Privacy: Any information collected from an Entrant will be subject to Sponsor’s Privacy Policy, located at http://www.skenergyshots.com/legal/privacy_policy/. (the “Policy”).  By entering the Sweepstakes, Entrants acknowledge agreement to such Policy, and each Entrant consents to the collection, use and disclosure of that Entrant’s personal information for the purposes of administering this Sweepstakes in accordance with such Policy.  If an Entrant desires to access or correct personal information held by Sponsor, opt out of receiving further communications from Sponsor or Sponsor’s affiliated merchants or companies, or has other questions respecting the privacy policy, please contact Sponsor at [email protected]

Conduct:  By participating, Entrants agree to comply with and be bound by these Rules.  Failure to comply with these Rules may result in disqualification from the Sweepstakes.  Entrants further agree to comply with and be bound by decisions of Sponsor, which shall be final and binding in all respects. Sponsor reserves the right at its sole discretion to disqualify any individual it finds to be: (a) tampering or attempting to tamper with the entry process or the operation of the Sweepstakes or any Sponsor web site; (b) violating these Rules; (c) violating Sponsor’s Terms of Service, conditions of use and/or general rules or guidelines of any Sponsor property or service; or (d) acting in an unsportsmanlike or disruptive manner, or with intent to annoy, abuse, threaten or harass any other person.

Release and Limitation of Liability. By entering, Entrants release and hold harmless Sponsor, the Artist, twitter, Facebook and their respective parent, subsidiaries, affiliates, directors, officers, employees and related entities (collectively, “Releasees”) from any and all liability, claims or actions of any kind whatsoever for injuries, damages or losses to persons and property that may be sustained in connection with the receipt, ownership, or use of the prize from or arising out of participation in this Sweepstakes. Neither Sponsor nor Artist assume any responsibility or liability for: (a) any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of, Entries; (b) any incorrect or inaccurate information, whether caused by Entrants, printing errors or by any of the equipment or programming associated with or utilized in the Sweepstakes; (c) any problems or technical malfunction of any telephone network or telephone lines, computer on-line systems, servers, or providers, computer equipment, software, failure of any e-mail or Entry to be received by Sponsor on account of technical problems, human error or traffic congestion on the Internet or at any Web site, or any combination thereof, including any injury or damage to participant’s or any other person’s computer relating to or resulting from participation in this Sweepstakes or downloading any materials in this Sweepstakes; (d) technical or human error which may occur in the processing of Entries; or (e) any injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from Entrant’s participation in the Sweepstakes or receipt or use or misuse of any prize.

Force Majeure:  The failure of the Releasees to comply with any provision of these Rules due to an act of God, hurricane, war, fire, riot, earthquake, act of public enemies, actions of governmental authorities outside of the control of the Releasees (excepting compliance with applicable codes and regulations) or other force majeure event will not be considered a breach of these Rules.

Internet: If for any reason this Sweepstakes is not capable of running as planned due to infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of Sponsor which corrupt or affect the administration, security, fairness, integrity or proper conduct of this Sweepstakes, Sponsor reserves the right at its sole discretion to disqualify any individual who tampers with the entry process, and/or to cancel, terminate, modify or suspend the Sweepstakes.

CAUTION: ANY ATTEMPT TO DELIBERATELY DAMAGE ANY WEB SITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES OR OTHER REMEDIES FROM ANY SUCH PERSON(S) RESPONSIBLE FOR THE ATTEMPT TO THE FULLEST EXTENT PERMITTED BY LAW.

In the event of a dispute as to the identity of a winner based on an e-mail address, the winning Entry will be declared made by the authorized account holder of the e-mail address submitted at time of Entry. “Authorized account holder” is defined as the natural person who is assigned to an e-mail address by an Internet access provider, online service provider or other organization (e.g., business, educational, institution, etc.) that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address.

Disputes: Except where prohibited or otherwise outlined in these Rules, Entrant agrees that: (a) any and all disputes, claims and causes of action arising out of or connected with this Sweepstakes or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the appropriate New York State Court; (b) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Sweepstakes, but in no event attorneys’ fees; and (c) under no circumstances will Entrant be permitted to obtain awards for, and Entrant hereby waives all rights to claim, indirect, punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. All issues and questions concerning the construction, validity, interpretation and enforceability of these Rules, or the rights and obligations of the Entrant and Sponsor in connection with the Sweepstakes, shall be governed by, and construed in accordance with, the laws of the State of New York, without giving effect to any choice of law or conflict of law rules (whether of the State of New York or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of New York.
